Justice Department moves to toss conspiracy convictions for Jan. 6 rioters

The reason this differs so much from a pardon is because you have one DoJ who says not only do we have a case, but we believe it is a winning one by bringing it. The court and jury and appeals process all affirm that and they get the guilty verdict and it's upheld in appeals but the subsequent DoJ comes in after the fact... says we want to undue all of this as there is no case here. But they do not offer a single reason or piece of evidence or data.

They make the entire court and jury process worthless saying none of it matters if the next DoJ disagrees.

That is exactly what Trump's DoJ filed. Just a statement they are pulling back the indictments with no evidence, data or reason why the convictions were wrong.

What a just process DOES NOT have is one person alone who nullifies prosecutions in this way as if they never happened. Pardoning is one thing but this is way worse.

Judges do that all the time in bench trials. Judges also make singular rulings all the time.
This is 3rd world shit and unless you say you would be ok with a future AOC or Bernie type POTUS going thru the ranks of convictions that tend tooffend their leftist politics and undoing them and so on and so on, as every new admin comes in, you are a raging hypocrite

The courts don't bring charges. Prosecutors do. Conspiracy charges require an underlying conspiracy. Conspiracies are not spontaneous. They require planning and a meeting of minds. A riotous mob is not usually made up of conspirators.
Calls to hang Mike Pence, to harm the Congress people and to usurp the authority? Looks like a conspiracy to me. :dunno:

The judge in that instance is the check and balance to potential prosecution abuse. The appellate courts then check and balance that judge.

What Trump and his DoJ are doing has no check and balance. They are saying the prior DoJ and Prosecution is wrong. The judge and jury trial verdict was wrong. The appellate courts are wrong.

That is why you refuse to say if you would support AOC or any other future left wing POTUS vacating convictions they disagree with.

I would be against them doing as I am with Trump as I have what you do not in a principled position.

They are doing so with out offering a single piece of new evidence or data and just saying 'we disagree and we have all the power'.

Trump wanted a jury trial in the Lettia James case. The judge summarily denied that and he got a bench trial. In the other "felony" case, the judge issued convoluted and long-winded jury instructions that ignored written NY law, but who's counting?

If the political bosses at the DOJ say go after someone, the lower level prosecutors go after someone.

And again, in every grievance you have that you state above there is a multi appeal process if you think a ruling was made in error.

What Trump is doing here is the action of a dictator or king with no ability to challenge, check or balance.

If an extreme left wing POTUS got in and just said "I do not believe in property crime and so I'm having my DoJ undue all such convictions" you would call it out.

Because this is Trump you will lie about that. But you have a lefty POTUS summarily undoing all the convictions on crimes they do not think should be crimes you will cry the loudest
